Five of the most common concerns for those going through divorce

ISSUE 1
How do I achieve financial security after I'm divorced?
Emotionally, divorce can range from invigorating to petrifying. What unites almost everyone is the desire for financial security which can be permanently destabilised if effective decisions aren't made. You'll want the means to live a comfortable lifestyle for yourself and your kids if you have any, as well as secure your long term financial future.

Using sophisticated cash flow modelling, we can work out the long term impact of divorce on your assets, model the consequence of different decisions you may be weighing up and formulate a strategy to ensure you can still achieve your long term life and retirement goals independently.
ISSUE 2
How do we divide our pensions on divorce?
It depends. The complexity of sharing pensions is dependent on a number of factors including your respective ages, the type of pension schemes you both have, whether there are any safeguarded benefits or guarantees, whether you have protected pension ages or underlying health issues.

Quantifying the true value of your pensions is important to make sure that you achieve a fair outcome. This normally requires a Pension Sharing Report, which we can help to get. With the analysis complete and Pension Sharing Order issued, we can implement the Pension Sharing Order and get your retirement income strategy structured in a way that’s right for you.
ISSUE 3
Do I need a lawyer to help achieve a financial settlement?
It is possible for you to reach a financial settlement without using lawyers, these days more than ever thanks to online resources. This is true, in theory, even if you have lots of assets, including pensions or if you have children together.

However, the greater the complexity, the more pertinent independent legal advice will be, and vital if there is any kind of disagreement or dispute. It is crucial to make sure that the financial settlement you agree is fair, taking into account of all the circumstances. It's also of paramount importance that you receive a court order in support of the settlement terms you agree. We can help guide you through this process.

So the short answer is 'no' but we would recommend taking some legal advice in most scenarios.
ISSUE 4
What is a clean break order and do I need one?
A clean break order is simply a court order confirming the terms of your financial settlement together with a 'clean break clause' which means no further claim or changes can be made in the future. You don't have to have one but, without it, your ex could still have a claim on your property, inheritance or pension, many years after divorce.

Getting the court order is a straightforward process, but agreeing how best to settle the finances in order to achieve the clean break can a challenge. We can take care of the background work to help you reach an agreement.
ISSUE 5
How do I manage my wealth after divorce?
If your partner managed the finances, doing it yourself can be a daunting prospect. We can give you the knowledge you need to confidently manage your finances and enable you to take control of your financial future.

We can operate any aspect of your financial life where you want professional support. You can hand over as much or as little responsibility as you'd like, giving you space to build a flourishing life as an independent person.

FAQ

Your questions answered

We’re here to help with any questions or doubts you might have
We already have a pension sharing order, how can you help?
The pension provider will receive the court order directly and write to you with the options available. This must be done by them within four months.

We would look at those options as well as any other pensions you have to assess what the best solution for you would be.
What do you do that my solicitor can't?
Whilst there is common ground between legal and financial matters, we have very different roles. We would work out your cash flow, assess your retirement position, structure your tax affairs and implement pension sharing, for example. Your lawyer would help you through the legal process of divorce.

We work in partnership with your legal team to ensure you get the best outcome possible from your separation or divorce.
How do you charge?
Our fees are based on the complexity of your situation and the scope of work we agree. We undertake a fair value assessment before engaging with a new client. Our fair value guarantee means that our fees will always be fair, proportionate and offer excellent value or we won't work with you.
“Ultimately, we all have to decide for ourselves what constitutes failure, but the world is quite eager to give you a set of criteria if you let it.”
